Dr. Abdul Rahman Abdul Manan Al Awar, Minister of Human Resources and Emiratisation, issued Ministerial Resolution No. 296 of 2023 regarding criteria for imposing administrative fines in accordance with Cabinet Resolution No. 95 of 2022 regarding violations and administrative penalties related to the initiatives and programs of the UAE Cadres Competitiveness Council and its amendments.

And the decision, which came into effect on June 2, 2023, stipulates that in the event that the establishment circumvents the Emiratisation targets by reducing the numbers or amending the classification of its workers, with the aim of circumvention or any other form of fraud proven by the Ministry of Human Resources and Emiratisation, the Ministry of Human Resources and Emiratisation will Imposing an administrative fine of 100,000 dirhams for the first time, for the second time an administrative fine of 300,000 dirhams is imposed, and for the third time, or any other time, an administrative fine of 500,000 dirhams is imposed.

The decision stated that in the event that the facility carries out fictitious localization in violation of any of the localization decisions and Nafis initiatives and programs, an administrative fine of 20 thousand dirhams will be imposed for each case of a fictitious localization employee in the first time, and in the second time an administrative fine of 50 thousand dirhams will be imposed for each case. A mock localization employee, and for the third time or any other time, an administrative fine of 100,000 dirhams will be imposed for each case of a mock localization employee.

And the decision indicated that in the event of submitting incorrect documents or data to obtain the services or benefits of a competitor, an administrative fine of 20,000 dirhams will be imposed for each case in the first time, and in the second time an administrative fine of 50,000 dirhams will be imposed for each case. For the third or any other time, an administrative fine of 100,000 dirhams will be imposed on the case.

The decision stipulates that in the event that the required documents are not valid, or they are not renewed within the prescribed time period, an administrative fine of 2,000 dirhams will be imposed for each month, with a maximum of 5,000 dirhams, and in the event that the establishment fails to take the prescribed measures in accordance with Decree-Law No. 33 of 2021. Concerning the organization of labor relations, its amendments, its executive regulations, and the decisions implemented in the following cases: the beneficiary’s failure to join the work after issuing the work permit and the establishment obtaining support from the council, or the beneficiary’s irregularity in working for the establishment after joining, or the beneficiary’s interruption of work and the establishment’s failure to notify the council, An administrative fine of 20,000 dirhams is imposed on each citizen.

The decision also stipulates that in the event that the facility terminates the service of the beneficiary and reassigns him to the same facility with the aim of obtaining support from the Council, an administrative fine of 20 thousand dirhams will be imposed for each case in the first time, and in the second time an administrative fine of 50 thousand dirhams will be imposed. For each case, and for the third time or any other time, an administrative fine of 100,000 dirhams is imposed for each case, and in the event that the establishment fails to report any change to the terms of use for any reason acceptable to the Council, an administrative fine of 20,000 dirhams is imposed For each case after notifying the council of the violation.
