Decree-law regarding the National Center for Early Inquiry, as of January 2, 2023

The UAE issued Federal Decree-Law No. 52 of 2022 amending some provisions of Federal Decree-Law No. 22 of 2018 regarding the National Center for Early Inquiry, and it comes into force as of January 2, 2023.

The decree-law stipulates that 10 categories are subject to the system, “which is the set of rules, procedures, and requirements required to obtain data and information of travelers during their stay in the country, in addition to data and information related to baggage, shipments, and means of transportation from the carrier or agent in advance, and to analyze them and assess security risks in accordance with the provisions of the law.” The goals and specializations of the center », provided that you adhere to registration, and include the ten categories: commercial airlines operating in the field of transporting passengers and luggage, commercial and private air transport companies operating in the field of transporting luggage and shipments, ground air services companies and aircraft operators operating in the field of transporting passengers and luggage, companies Commercial and private maritime navigation working in the field of transporting passengers, baggage and cargo, land transport companies whose activity extends beyond the borders of the state and operating in the field of transporting passengers, baggage and cargo, agents of land, air and sea shipping companies, the operating and concerned authorities in accordance with the provisions of this Decree-Law, customs authorities and departments and local ports, Local economic departments to provide data on commercial licenses operating in the field of transporting money Travel, baggage and cargo, other categories for which a decision is issued by the Chairman of the Authority or his authorized representative.

The decree-law also stipulates that the executive regulations specify the violations and administrative penalties imposed by the Federal Authority for Identity and Nationality, Customs and Ports Security – after its approval by the Council of Ministers – in the event of breaching any of the provisions of this decree-law and the decisions implementing it, provided that the minimum administrative fine is not less than In case of repetition or non-compliance with the provisions of this Decree-Law, even if the amount of the fine exceeds the maximum limit in accordance with the provisions of this Article.

The Decree-Law stipulates that without prejudice to the provisions of Article 13 of this Decree-Law, the President of the Federal Authority for Identity, Nationality, Customs and Ports Security may take any of the following measures based on a recommendation from the Director General: stop practicing commercial activity or withdraw the license for a period of no less than 3 months, In coordination with the concerned authorities, and cancel the registration of the carrier or agent from the system, in which case the concerned authorities are obligated to take the necessary measures to stop, cancel or withdraw the license or authorization to practice the commercial activity of the carrier or agent in the country.

The Decree-Law also stipulates that whoever has been subjected to a penalty or an administrative measure in accordance with the provisions of this Decree-Law and its implementing regulations may file a grievance with the Director-General within a period not exceeding 30 days from the date of his notification of the decision to impose the penalty, and the Director-General may accept the grievance and cancel the decision issued to impose the penalty. The grievances he deems unacceptable shall be referred to the Grievances Committee within a period not exceeding 30 days from the date of the Authority’s submission of the grievance request.
