The Ministry of Human Resources and Emiratization canceled the suspension of more than 27,000 establishments that committed offenses before August 1st and allowed the issuance of new work permits for specific cases of workers who had been issued before August 1st, as well as decrees banning permits for violating the law. This came after the Supreme National Committee for the Year of Tolerance, chaired by His Highness Sheikh Abdullah bin Zayed Al Nahyan, Chairman of the Committee adopted two separate decisions issued by His Excellency Nasser bin Thani Al Hamli, Minister of Human Resources and Emiratisation on the abolition of the moratorium on enterprises and tolerance of some violating workers.
His Excellency Nasser Bin Thani Al Hamli said: “The two resolutions are part of the initiatives of the Ministry of Human Resources and Emiratisation, in line with the Year of Tolerance, which reflects the keenness of the wise leadership to strengthen the noble human values ​​system in the UAE society, which hosts various cultures of the world in the light of the rule of law and values. Tolerance, dialogue and acceptance of the other and openness to it. ”
His Excellency affirmed the Ministry’s constant endeavor to enhance the value of tolerance in the labor market and transform it into sustainable institutional work in a way that contributes to achieve more stability in the labor relationship through supporting employers and workers and reducing their burdens in a way that does not contradict the law to achieve the happiness of both sides of this relationship. .
He explained that the two decisions constitute an important opportunity for enterprises and workers benefiting from them to adhere to the law and the resolutions and its implementation and thus not to commit violations that would expose them to the penalties provided for.
For her part, Noura Al-Marzouqi, Undersecretary of the Ministry of Human Resources and Assistant Resettlement of Policies and Strategy, explained that the lifting of the moratorium on the concerned establishments came after the ministry confirmed that these establishments are not suspended by other parties, as well as the fulfillment of all the rights of its employees The state as well as to ensure that the suspension was decided because of the referral of the establishment concerned to the judicial authorities and has not been decided on this referral until the effective date of this decision.
She pointed out that the decision applies to the cases of facilities suspended because of non-review of the inspection and other reasons that necessitated the suspension of the facilities concerned before the date of August 1, 2019.
On the decision to tolerate some offending workers, Marzouqi explained that the decision benefited from the offending workers before August 1, 2019, where new work permits were allowed for two categories of workers who were previously denied permits.
She added that the first category included workers in the UAE from the third, fourth and fifth skill levels, who were agreed between them and employers to end the working relationship during the trial period in contravention of the regulations in force at the ministry.
It is noteworthy that the Ministry of Human Resources and Emiratisation requires that new work permits be granted to workers at the above mentioned levels one year after the date of termination of the working relationship between the two parties, in the event that this relationship ends amicably between the two parties during the trial period of six months, which is exempted workers in the two skill levels. the first and the second.
It should be noted that the first skill level includes specialized occupations, which require a high degree of scientific, technical and administrative skills with a minimum university degree, while the second skill level includes technical occupations, which require the availability of mental skills “scientific and technical” and practical skills and supervisory qualification of an intermediate institute from two to three years. After high school.
The third skill level includes occupational workers that require practical and vocational skills that cover the profession framework in an integrated secondary stage qualification, while the fourth skill level includes workers who occupy occupations that require completion of practical and vocational skills related to part of the profession among the occupants.
The fifth skill level includes the limited skill category and occupations that require completion of the availability of practical and professional skills related to a small part of the profession.
The Undersecretary of the Ministry of Human Resources and Assistant Emiratisation for Policies and Strategy pointed out that the second category benefiting from the said decision included workers in the country who did not review the ministry after the issuance of judicial rulings in labor disputes related to this labor, in violation of the regulations in force at the ministry The worker shall review the Ministry within 60 days from the date of issuing the judicial ruling.
