Abu Dhabi Judicial Department Organizes Seminar on “Justice and Investment”

The Abu Dhabi Judicial Department, in cooperation with the French Judicial School, organized a seminar entitled “Justice and Investment” to deepen the discussion and exchange of ideas on the mechanisms to enhance the investment environment through a developed judicial system.
The symposium was organized within the framework of implementing the ambitious vision of the Department in line with the directives of His Highness Sheikh Mansour bin Zayed Al Nahyan, Deputy Prime Minister and Minister of Presidential Affairs and Chairman of Abu Dhabi Judicial Department, to develop a leading judicial system that plays a pivotal role in attracting foreign investments and capital. The emirate’s position as an attractive business environment and a destination for skilled labor, which requires investors to have easy access to justice.
Ali Shair Al Dhaheri, Director of the Judicial Inspection Department in Abu Dhabi, said during the opening speech of the symposium that countries are seeking in an open race to attract foreign capital, and the law can play an important role in enhancing competitiveness, and recognizing the importance of legislation in enhancing the investment environment and the competitiveness of the state. The legislator in the UAE has to promulgate several laws, regulations and related regulations that encourage investment.
He pointed out that one of the most important legal guarantees to protect foreign and national investment is to provide a specialized and speedy judiciary to resolve investment-related disputes. Therefore, the Abu Dhabi Judicial Council has adopted the principle of specialization in commercial cases. Investment, since its inception, has played an important role in the resolution of those disputes, both in terms of speed and level of judgments.
He added that the commercial judiciary is now required to open up to its external environment and to be acquainted with judicial experiences and other legal cultures, taking into account the necessity of not only legal training.Therefore, the Judicial Department has supported its contract with a group of foreign experts in the field of commercial justice.
For his part, Counselor Beno شt Shmouard, Director of the International Department of the French National School of Justice, said that the symposium of justice and investment is especially important in light of the effective role of justice in attracting investments and creating an attractive environment, by keeping pace with legislation and judicial systems of the developments in this vital area.
The seminar was moderated by Counselor Mohammed Saad Al Shaqfa, President of the Abu Dhabi Court of Appeal, during which François Ancel, judge of the Court of Appeal of Paris, President of the International Commercial Court, spoke about the attractiveness of the law and the measures taken in the French judicial system to reform the contract law, and work to strengthen the attractiveness achieved. Confidence for investors through the amendment and development of many laws and give them a lot of flexibility, and the development of a new system of alternative solutions to resolve disputes.
Ali Bakhit Alkatheeri, Chairman of the Second Commercial Division and the Bankruptcy Department at the Abu Dhabi Commercial Court, addressed the role of the Commercial Court in strengthening the economic system of the Emirate of Abu Dhabi and supporting its competitiveness to occupy a prominent position among the best international judicial systems. For his part, Advisor Fahad Al-Tamimi, a judge at the Abu Dhabi Commercial Court, touched on the efforts of the Judicial Department in applying international standards of competitiveness, and work to reduce the litigation procedures in simple cases, and activate the positive role of the Court in issuing orders, as there are 100 types of judicial orders issued during the 24 hours.
